Rules for determining legislation applicable (determining the Member State of insurance) in accordance with Regulations (EC) Nos 883/2004 and 987/2009, posting of workers, A1 form

If persons migrate for work, it is necessary to know in which state they will be insured for the purposes of pension, sickness, and health insurance. This is governed by the social security legislation of the Member State that has been identified as applicable in accordance with Regulations (EC) No 883/2004 and 987/2009 of the European Parliament and of the Council. These legal regulations govern the payment of insurance premiums and benefits.

The above regulations contain rules for determining the legislation applicable, and there are designated institutions in each country that decide on their application. In the Czech Republic, in the case of active persons, i.e. employees and self-employed persons, these are the Czech Social Security Administration and Social Security Administrations. In the case of inactive persons (e.g. non-employed students or pensioners), it is the Health Insurance Bureau. Information on procedures abroad areto be found out at the local institution.
