Submission of application


Generally, an applicant may submit his or her pension application (including a survivor's pension) in any Member State. As a rule, an application for a pension shall be filed with an institution of the Member State where the applicant resides, even if he/she has never been insured in that State. The institution of the State of residence will then send the application to the institution in the State where the concerned person was insured for retirement. The date of initial application shall be deemed the date of filing the application by all institutions in other Member States under the legislation of which the applicant has been insured. This solution is in the interest of the person concerned, as it will be easiest for him/her to submit an application where he/she resides.

A pension application may also be submitted to the institution of the State where the person concerned was last insured, unless he/she was insured in the State where he/she resides.

The application shall be submitted only in one Member State.

The system of exercising pension rights under the EU social security law is ultimately advantageous for the client, but in terms of the length of proceedings, it is necessary to take into account periods of several months. Once the entitlement to a pension is exercised, no institution with which the claimant was insured has all the necessary data available and such data must therefore be exchanged between them and some must be found - the period of the pension proceedings in the Member States is different and CSSA cannot influence the procedure of other institutions.
